By creating an account or using the VisibilityIQ service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms, and "you" refers to both you and that business.
If you do not agree to these Terms, do not use the Service.
VisibilityIQ provides an automated monthly reporting service that analyzes the digital visibility of a website you provide and generates a report covering:
Reports are generated using a combination of data from Google Search Console (if connected), publicly available website data, third-party APIs, and AI-generated narrative content. The specific data sources, scoring methodology, and features available may change over time.

You are responsible for all activity that occurs under your account. You must notify us immediately at support@visibilityiq.co if you become aware of any unauthorized use of your account.
Each subscription covers one (1) website. Creating multiple accounts to circumvent this limit is a violation of these Terms and may result in account termination without refund.
VisibilityIQ offers paid subscription plans ("Pro" at $49.99/month and "Starter" at $29.99/month). Current pricing is displayed at visibilityiq.co/#pricing. We reserve the right to change pricing with 30 days' notice to existing subscribers.
Subscriptions are billed monthly in advance. Payment is processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel. All amounts are in US Dollars unless otherwise stated.
You may cancel your subscription at any time from your billing settings page. Cancellation takes effect at the end of the current billing period — you retain access to the Service until that date. We do not provide prorated refunds for partial months.
We offer a 7-day money-back guarantee for new subscribers. If you are not satisfied with the Service within the first 7 days of your first paid subscription, contact us at support@visibilityiq.co for a full refund. After 7 days, all payments are non-refundable except as required by applicable law.
If a payment fails, we will attempt to charge your payment method again. If payment cannot be collected after reasonable attempts, your account will be suspended and then terminated. You will receive email notification before any suspension.
You retain full ownership of your business data, website data, and any content you provide to VisibilityIQ. By using the Service, you grant us a limited, non-exclusive license to access, process, and analyze your data solely for the purpose of providing the Service to you.
You represent that you have the right to provide any website URL you submit for analysis, including the right to authorize us to crawl and analyze that website.
Upon account termination, your data will be deleted within 30 days as described in our Privacy Policy. You may request an export of your report data at any time by contacting us.
VisibilityIQ, including the scoring methodology, platform design, software, and all content we create (excluding your business data and report content generated from your data), is owned by us and protected by intellectual property laws. Nothing in these Terms transfers ownership of our intellectual property to you.
You may not copy, reverse engineer, scrape, or create derivative works based on the VisibilityIQ platform without our express written permission.

The Service integrates with third-party services including Google (Search Console, PageSpeed, Custom Search), Stripe, Anthropic, and Resend. Your use of these integrations is also subject to those providers' terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services.
By connecting Google Search Console, you also agree to Google's Terms of Service and authorize us to access your GSC data on a read-only basis as described in our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VISIBILITYIQ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain types of liability, so the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless VisibilityIQ and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any third-party rights; or (d) any content or data you submit to the Service.
You may terminate your account at any time by canceling your subscription and deleting your account from the Settings page, or by contacting us.
We reserve the right to suspend or terminate your account, with or without notice, if:
Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account closure as described in our Privacy Policy.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Before filing any formal legal claim, you agree to first contact us at legal@visibilityiq.co and attempt to resolve the dispute informally for at least 30 days.
Any disputes not resolved informally shall be submitted to binding individual arbitration under the rules of the American Arbitration Association (AAA). You waive any right to participate in class action proceedings. This arbitration clause does not prevent either party from seeking emergency injunctive relief in court.
If you are located in the European Union, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those Terms.
If you do not agree to the revised Terms, you may cancel your account before the effective date without penalty.
